Promoting GNH Through Education
In most of the world, environmental law acts as a referee between economic growth and ecological damage. It is often a system of “managed destruction,” deciding how much pollution is acceptable in exchange for GDP growth.
In Bhutan, the script is flipped. Our legal framework is built on the philosophy of Gross National Happiness (GNH). GNH is not merely a measure of sentiment; it is a rigorous, multi-dimensional development paradigm that places the well-being of all life forms above pure
economic profit.

The Environment is a Pillar, Not a Resource
In a standard legal system, the economy is the engine, and the environment is fuel. Under GNH, the Environment is a foundational pillar, equal in weight to the Economy. This means that a law cannot prioritize short-term profit if it compromises the long-term health of the ecosystem. This philosophy is codified in Article 5 of the Constitution of Bhutan, which mandates that 60% of the nation remain forested for all time.
GNH rests on four pillars:

2. Preservation of Culture
3. Conservation of the Environment
4. Good Governance
From Ownership to Trusteeship
Western jurisprudence often views land as “property”— something to be owned, used, and sold. GNH shifts the legal framework from Ownership to Trusteeship.
Intergenerational Equity
The current generation does not “own” Bhutan’s natural resources. We are merely trustees holding them in custody for future generations. This legal concept of Intergenerational Equity ensures that our laws look forward, protecting the rights of citizens who are not yet born.
The Interdependence of Systems
